1. Overview

These Terms of Service govern access to carolinalinens.shop and purchases made through the website. By using the website or placing an order, the user agrees to these terms, together with the Privacy Policy, Return and Refund Policy and Shipping and Delivery Policy. Mandatory consumer rights are not excluded or restricted.

2. About the store

carolinalinens.shop offers home and bathroom products, mattresses, sleep products, curtains, window furnishings and related goods. Customer service can be contacted at info@carolinalinens.shop. The legal trader’s full identity and geographic address must be displayed separately before the website is published as fully compliant; the website name alone is not a legal entity.

3. Eligibility and acceptable use

Users must have legal capacity to enter a contract and must provide accurate, current and complete information. The website must not be used for unlawful purposes, fraud, harmful interference, unauthorised access, scraping that disrupts the service, distribution of malicious code, infringement of rights or resale activity that we have not agreed to support.

4. Product information

We take reasonable care to describe products accurately. Images are illustrative, screen settings and lighting can affect colour, and soft goods may have minor manufacturing or measurement tolerances. Natural materials and patterned fabrics may show variation. A material discrepancy, fault or misdescription remains subject to statutory remedies.

Customers must review dimensions, materials, pack quantities, variation selections, care instructions, compatibility and installation requirements. For mattresses, firmness descriptions are general guidance and comfort is subjective. For curtains, customers should verify whether measurements apply per panel or per pair and account for the intended fullness and fitting method.

5. Prices and taxes

Prices are those displayed at checkout and may change before an order is placed. Where applicable, displayed consumer prices include VAT unless the website clearly states otherwise. A price change does not affect an accepted order except where there is an obvious error that a reasonable customer would recognise.

Promotions are subject to their stated conditions, availability and end dates. Discount codes cannot be exchanged for cash and may not be combined unless expressly allowed. We may correct genuine pricing, description or availability errors before accepting an order.

6. Ordering and contract formation

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. The contract is formed when we send an acceptance or dispatch confirmation, or otherwise clearly confirm acceptance. We may refuse or cancel an order before acceptance because of stock, payment, fraud, delivery restrictions, an obvious error or another legitimate reason.

If we cannot accept an order after receiving payment, we will refund the relevant amount to the original payment method. We may apply reasonable quantity limits to protect availability and prevent unauthorised commercial resale.

7. Payment

The customer authorises the chosen payment provider to charge the total shown at checkout. Payment may be subject to provider verification, fraud screening and authorisation. We do not control delays caused by a bank or payment provider. Ownership of goods passes as provided by applicable law and risk normally passes when the consumer or their nominated recipient takes physical possession.

8. Delivery

All orders qualify for free standard delivery. The estimated delivery time is 15–20 calendar days, calculated as described in the Shipping and Delivery Policy. Estimates are not guaranteed dates. We will contact the customer if a material delay becomes known and will respect any statutory right to cancel where delivery is not made within an agreed or legally required period.

The customer must supply a complete and accurate delivery address and ensure reasonable access. For bulky items, the customer should check entrances, stairs, lifts and room access. Delivery does not include assembly, installation, connection, removal of old products or disposal of packaging unless expressly stated.

9. Inspection, installation and use

Customers should inspect goods before installation or alteration. Products must be used for their intended purpose and in accordance with warnings, product instructions and care guidance. Bathroom fittings and other products requiring specialist work should be installed by a competent person. We are not responsible for damage caused by incorrect installation, misuse, unauthorised modification, neglect or failure to follow instructions, except where liability cannot lawfully be excluded.

10. Cancellations, returns and refunds

Cancellation and return rights are set out in the Return and Refund Policy. Made-to-measure or clearly personalised curtains, blinds, poles and similar products may be excluded from change-of-mind cancellation. Lawful hygiene exclusions may apply to certain sealed bathroom, bedding and sleep products after unsealing. These exclusions do not remove remedies for faulty or misdescribed goods.

11. Consumer rights and product conformity

Goods supplied to consumers must conform to the contract and the statutory requirements in sections 434 and following of the BGB. Where goods are defective, the consumer may request subsequent performance and, when the legal requirements are met, reduce the price, withdraw from the contract or claim damages. Nothing in these terms limits those rights or an applicable statutory guarantee period.

12. Website availability

We may update, suspend or withdraw parts of the website for maintenance, security, operational or legal reasons. We do not guarantee uninterrupted access or that every feature will always be available. This does not affect an existing order or any obligation already owed to a customer.

13. Accounts

A user is responsible for keeping account credentials confidential and for activity conducted through the account unless caused by our failure to use reasonable security. We may suspend an account where reasonably necessary to investigate fraud, misuse, security risk or breach of these terms. Users should contact us promptly if they suspect unauthorised access.

14. Reviews and user content

If a user submits a review, image or other content, the user confirms that it is accurate in substance, lawful, not misleading, not infringing and not confidential. The user grants us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating and promoting the store, subject to applicable privacy and consumer-review laws. We may moderate unlawful, abusive, irrelevant or fraudulent content but will not suppress a genuine review merely because it is critical.

15. Intellectual property

Website text, layout, graphics, branding and other content are protected by intellectual-property laws and may be used only for personal, non-commercial shopping purposes unless permission is granted. Third-party product names and marks belong to their respective owners. Nothing transfers ownership of intellectual property to the user.

16. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of mandatory consumer rights. Subject to those protections, we are not responsible for losses that were not foreseeable when the contract was made or for business losses arising from a consumer purchase.

A customer is responsible for reasonably foreseeable loss caused by failure to provide correct measurements, select the correct variation, follow care or installation instructions, or ensure suitable access, except to the extent the loss was caused by our breach or cannot lawfully be allocated to the customer.

17. Events outside reasonable control

We are not responsible for delay or failure caused by events outside reasonable control, such as severe weather, carrier disruption, industrial action, transport restrictions, natural disaster, epidemic, cyber incident, government action or supplier interruption. We will take reasonable steps to reduce the effect and will communicate material delays. Statutory cancellation and refund rights remain available where applicable.

18. Changes to these terms

We may change these terms prospectively to reflect legal, operational or service changes. The terms applying to an order are normally those in force when the order is placed, unless a change is required by law or agreed with the customer.

19. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, to the extent this choice is permitted. If the consumer habitually resides in another country, the choice of German law does not deprive the consumer of mandatory protections that cannot be excluded under the law of that country. 20. Severability and no waiver

If a provision is found invalid or unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver of that right. No third party has a right to enforce these terms unless the law provides otherwise.
